Dezvaluiri uluitoare: Acum se intelege ce se afla in spatele evenimentelor judiciare din ultima vreme
Senatorul Valer Marian, senator independent, fost procuror, cel care l-a anchetat imediat dupa decembrie 89 pe Nicusor Ceausescu si faptele asociate acestuia de la Sibu, unul dintre politicienii care continua sa faca interpelari-ancheta, ii trimite presedintelui Klaus Iohannis inca o scrisoare deschisa, in care face dezvaluiri bomba, din care toata lumea poate sa inteleaga ce se afla in spatele evenimentelor judiciare si politice din ultima vreme. Redam in continuare scrisoarea senatorului Valer Marian:
“Având în vedere atribuţiile preşedintelui României privind numirea procurorului general al Parchetului de pe lângă Înalta Curte de Casaţie şi Justiţie şi a procurorilor şefi ai DNA şi DIICOT, la propunerea ministrului justiţiei şi cu avizul Consiliului Superior al Magistraturii, consider că este firesc şi binevenit să ştiţi ce oameni au fost promovaţi în fruntea acestor unităţi de parchet, în prima jumătate a anului 2013, de către predecesorul dumneavoastră Traian Băsescu, în tandem cu primul ministru Victor Ponta, care a deţinut portofoliul de ministru interimar al justiţiei în perioada în care au fost operate aceste numiri, în baza mult discutatului şi contestatului pact de coabitare încheiat între şeful statului şi şeful guvernului .
Principalul criteriu de selecție a lui Kovesi: amiciția cu șefa de cabinet a lui Macovei
Cele mai multe discuţii le-a comportat numirea doamnei Laura Codruţa Kovesi în funcţia de procuror şef al DNA, după ce anterior, timp de şase ani (2006-2012), în care a deţinut funcţia de procuror general al Parchetului de pe lânga Înalta Curte de Casaţie şi Justiţie, o fost percepută drept un instrument sau o slugă a preşedintelui Traian Băsescu, a ministrului justiţiei Monica Luisa Macovei şi a generalului Florian Coldea, primul adjunct al directorului SRI (şi seful de facto al principalului serviciu secret al ţării). Laura Codruţa Kovesi a fost numită procuror general al României, în mod surprinzător, în cursul anului 2006, la vârsta de 33 ani , de către preşedintele Traian Băsescu la propunerea ministrului justiţiei Monica Luisa Macovei, deşi nu se remarcase până atunci în domeniul practicii şi doctrinei judiciare. Kovesi a fost o studentă mediocră, conform unor profesori de-ai săi de la Facultatea de Drept a Universităţi Babeş Bolyai Cluj Napoca, şi avea o experienţă de procuror de circa 10 ani, fără rezultate sonore, activând la Parchtetul de pe lângă Judecătoria Sibiu şi apoi la structura locală a DIICOT. Kovesi devenise cunoscută şi agreată la Sibiu mai degrabă pentru că era fiica celui mai longeviv procuror şef din regimul ceauşist, tatăl său Ioan Lascu conducând Parchetul Mediaş (oraş cunoscut drept fieful gazului metan românesc) timp de 30 ani .
Fostul preşedinte Traian Băsescu a motivat la final de mandat că ar fi numit-o procuror general al României pe necunoscuta Laura Codruţa Kovesi întrucât i s-a spus că a avut cel mai bun randament în solutionarea cauzelor în calitate de şefă la DIICOT Sibiu. Fals, pentru că pe anul precedent numirii sale în funcţie, respectiv pe anul 2005, structura DIICOT Sibiu s-a clasat doar pe locul 10 din 16 unităţi de profil, deci în a doua parte a clasamentului întocmit pe baza criteriilor de performanţă profesională. De altfel Traian Băsescu a falsat și când a motivat că l-a numit pe Daniel Morar procuror șef la DNA întrucât anterior a avut curajul să aresteze un senator, referinduse la senatorul PD de Bistrița-Năsăud, Liviu Ciupe. Pe de o parte, Liviu Ciupe nu mai era senator la data arestării ci deținea funcția de director al Direcției Regionale de Drumuri și Poduri Cluj, și a fost arestat pentru pretinse fapte comise în această funcție, în care a fost numit taman de Traian Băsescu , pe atunci ministru al Transporturilor în gurvenul CDR-PD-UDMR. Conducerea PD a protestat atunci vehement împotriva arestării lui Ciupe, în mod deosebit vicepreședinții Ioan Oltean (care-i era amic și coleg în cadrul organizației județene Bistrița- Năsăud a PD) și … Traian Băsescu (care-i era șef și pe linie profesională). Pe de altă parte, arestarea lui Liviu Ciupe s-a dovedit nelegală, abuzivă, întrucât a fost achitat de toate instanțele de judecată din România , iar Curtea Europeană a Drepturilor Omului a condamnat și obligat statul român să-i achite despăgubiri de 500 000 euro pentru perioada în care a fost arestat abuziv de către procurorul Morar.
Revenind la Laura Codruța Koveși, așa cum am mai afirmat de-a lungul ultimelor trei ani în mai multe declarații politice , aceasta a fost numită în 2006 în funcția de procuror general al României pe criterii clientelare, în baza unor relații de prietenie și de colegialitate cu decidenți ai puterii portocalii. Cuvântul decisiv l-a avut ministrul justiției Monica Luisa Macovei, căreia Laura Codruța Kovesi i-a fost recomandată de către șefa sa de cabinet, judecătoarea Monica Niculescu, care i-a fost colegă de facultate (de an și de grupă) și prietena apropiată lui Kovesi . Anterior judecătoare la Cluj-Napoca, Monica Niculescu a fost soția deputatului PDL Rareș Niculescu , un apropiat al liderului PDL Emil Boc, iar, după promovarea sa în funcția de secretar general al Ministerului Justiției și de șef de cabinet al ministrului Monica Luisa Macovei, a devenit concubina jurnalistului Dan Tapalagă, care îndeplinea în perioada respectivă funcția de purtator de cuvant al ministerului justiției. Astfel se explică faptul că Dan Tapalagă a avut prioritate și chiar exclusivitate în devoalarea mediatică a unor stenograme din dosarele intrumentate de Parchetul General sau de DNA și chiar a unor rechizitorii. Dan Tapalagă este se pare “ziaristul care dădea ordine unui procuror șef” la care s-a referit Traian Băsescu la final de mandat, când directorul Hotnews a devenit mai critic la adresa sa, după ce mai mulți ani fusese unul din adulatării săi de serviciu.
Marea luptătoare anticorupție și pro integritate Monica Luisa Macovei a afirmat, în mai multe rânduri, că a propus-o procuror general al României pe Laura Codruța Kovesi în urma unei selecții riguroase . Nu putem fi însă atât de naivi să credem că din această selecție a ieșit câștigătoare tamam fosta colegă și prietenă apropiată din facultate a șefei sale de cabinet.Cu ocazia numirii, Laura Codruța Kovesi și păpușarii ei au profitat și de faptul că aceasta a fost colegă de facultate și cu președintele PD, Emil Boc, și că alt greu al PDL, secretarul general Vasile Blaga, se afla în relații apropiate cu tatăl său Ioan Lascu, printr-un prieten comun din Mediaș, Florin Muntean, lider local al PDL și director general al Societății Naționale Transgaz (pe care Blaga l-a etichetat “cel mai bun prieten din armată și din facultate”).
Conform unor procurori mai vârstnici sau mai tineri din cadrul Parchetului General și DNA, Traian Băsescu și Monica Macovei au aplicat principiul nulităților controlabile în cazul promovării lui Laura Codruța Kovesi și a lui Daniel Morar. Potrivit acestui principiu , în funcțiile cheie din instituțiile fundamentale ale statului au fost promovate cu precădere persoane mediocre profesional , obediente și șantajabile , relativ tinere și originare din provincie , pentru a putea fi controlate și manipulate de promotorii și protectorii lor politici. Simptomatic este că , datorită obedienței manifestate, Traian Băsescu a renominalizat-o pe Kovesi în funcția de procuror general al României în anul 2009, deși Consiliul Superior al Magistraturii (autoritatea supremă și reprezentatitvă a justiției din România) a respins categoric renumirea sa (cu 5 voturi contra și un vot pentru). Koveși a fost susținută puternic și de generalul Florian Coldea, primul adjunct al directorului SRI, după ce, sub oblăduirea sa, Parchetul General și DNA au devenit anexe ale SRI (performanță pe care securitatea nu a reușit -o cu procuratura în timpul regimului ceaușist). În fine, Băsescu și Coldea au impus-o pe Kovesi în funcția de procuror șef al DNA în 2013, reușind să înfrângă opoziția inițială a primului ministru Victor Ponta cu ajutorul pupilei prezidențiale Elena Udrea și al ambasadei SUA la București .
Alina Bica, promovată de tandemul Udrea- Băsescu, cu bunăvoința lui Ponta
Promovarea doamnei Alina Bica în funcția de procuror șef al DIICOT este în principal opera fostului președinte Traian Băsescu, dar a avut o anumită contribuție și premierul Victor Ponta. Prietenă cu Elena Udrea, Alina Bica a devenit și o apropiată a ex-președintelui Băsescu, care a invitat-o de mai multe ori la Palatul Cotroceni, potrivit unor angajați ai SPP. În 2010 Udrea și Băsescu au promovat-o pe Bica secretar de stat la Ministerul Justiției, unde aceasta trebuia să-l taloneze și să-l supravegheze pe ministrul Cătălin Predoiu, care sărise din guvernarea liberală a lui Călin Popescu Tăriceanu în guvernarea democrat-liberală a lui Emil Boc. În această calitate, Bica a devenit membru al Comisiei Centrale pentru Stabilirea Despăgubirilor, în care a tăiat și spânzuarat până în 2012 în marile și disputatele dosare de retrocedare de la Autoritatea Națională pentru Restituirea Proprietăților. Premierul Ponta a agreat numirea Alinei Bica în fruntea DIICOT întrucât a primit recomandări în acest sens de la generalul Ilie Botoș, consilierul său pe probleme de siguranță națională în perioada respectivă, care era foarte atașat de aceasta din anii în care a deținut funcția de procuror general al României și a avut-o subalternă, și de la genaralul Gabriel Oprea, nașul său la prima căsătorie și vicepremier pentru securitate națională, la care aspiranta era însrisă la doctorat. Interesant este că atunci SRI nu a furnizat nici șefului statului nici șefului guvernului, care deținea interimar portofoliul justiției, nici o informație privind implicarea Alinei Bica în acte de corupție, în calitate de procuror sau de secretar de stat la justiție .
În funcția de procuror șef-adjunct a fost numită, tot în 2013, în mod curios, Giorgiana Hosu, fără să o recomande vreun criteriu de performanță în materie. Coincidența face că Giorgiana Hosu a fost cea mai bună prietenă a Alinei Bica din Parchetul General și a fost o altă feblețe a ex-procurorului general Ilie Botoș. Coincidența mai face că Giorgiana Hosu a fost colegă cu Victor Ponta la Facultatea de Drept a Universității din București, la Parchetul de pe lângă Judecătoria Sectorului 1 București și la Parchetul General, având și ea o ascensiune profesională la fel de rapidă după absolvirea facultății, explicabilă în parte prin poziția și funcția soțului său în cadrul Inspectoratului General al Poliției Române. SRI nu i-a informat pe decidenți referitor la vreo vulnerabilitate din cariera lui Hosu, deși la adresa acesteia apăruseră acuzații în presă că ar fi pretins mită pentru a soluționa o plângere penală formultată de patronul firmei Farmec din Cluj Napoca și că soțul și fiul său vitreg ar fi avut afaceri profitabile dubioase cu frații libanezi Awdi, cunoscuți ca patroni ai firmei de distribuție a presei Rodipet. După arestarea Alinei Bica pentru fapte de corupție, Giorgiana Hosu a preluat conducerea DIICOT deși trecutul său profesional ridică multe semne de întrebare.
Tiberiu Nițu, pionul lui Ponta din fruntea Parchetului General
Tot în baza târgului din 2013, în funcția de procuror general al României a fost numit Tiberiu Nițu, cunoscut drept un apropiat al premierului Victor Ponta , cu care a fost coleg de facultate. A și fost vizibilă o anumită obediență a procurorului general Nițu față de premierul Ponta, daca avem în vedere ușurința și celeritatea cu care acesta a primit soluții de neîncepere a urmăririi penale sau de clasare din partea Parchetului Genaral în cazul mai multor plângeri penale formulate împotriva sa . A consternat îndeosebi soluția de neîncepere a urmăririi penale față de Victor Ponta pentru plagiatul evident comis în cazul lucrării sale de doctorat în drept.
Pot aduce drept argumentele și soluțiile emise în cazul a doua sesizări penale formulate de către subsemnatul împotriva președintelui PSD Victor Ponta și a socrului său Ilie Sârbu, liderul Grupului parlamentar al PSD din Senatul României. Astfel, în dosarul nr. 748/P/2013, având ca abiect plângerea formulată pentru abuz în serviciu, referitor la excluderea mea abuzivă din PSD, a fost dispusă clasarea cauzei, fără să fie administrate probele solicitate, procurorul de caz de la Parchetul General neavând nici măcar curiozitatea sau curajul să-i citeze și să-i audieze pe Victor Ponta și pe Ilie Sârbu, deși fusese începută urmărirea penală. Atitudinea părtinitoare față de Victor Ponta și apropiați săi a fost și mai evidentă în cazul unei sesizări penale depuse la Parchetul de pe lânga Înalta Curte de Casație și Justiție, care a fost înregistrată sub nr. 1549/ VIII-I / 2014, prin care am solicitat cercetarea senatorului Ilie Sârbu sub aspectul săvârșirii infracțiunilor de fals în declarații și complicitate la omor calificat. Prin această sesizare am relevat că Ilie Sârbu a declarat că nu a avut calitatea de colaborator sau de lucrător al Securității, cu ocazia depunerii candidaturii pentru Senatul României la alegerile parlamentare din 2004, 2008 și 2012, deși înainte de 1989 a fost informator al Securității, sub numele conspirativ “Ovidiu Marinescu” și apoi ofițer deplin conspirat al Centrului de Informații Externe (serviciul de spionaj al Securității), precum și că a fost implicat în represiunea sângeroasă a populației adunate în fața Catedralei Mitropolitane Ortodoxe din Timișoara în data de 17 decembrie 1989. Parchetul de pe lângă Înalta Curte de Casație și Justiție a arhivat în grabă această sesizare, cu motivarea că nu ar conține codul meu numeric personal, descrierea faptei și indicarea mijloacelor de probă. Ori, codul meu numeric personal era inserat în al treilea rând al primului aliniat al sesizării, starea de fapt era descrisă în cuprinsul a patru pagini, cu referire la fiecare infracțiune sesizată în parte, iar mijloacele de probă puteau fi deduse de un procuror profesionist din descrierea faptelor (înscrisuri, martori) și puteau fi precizate de către subsemnatul cu ocazia audierii în calitate de denunțător.
Cert și regretabil este că numirea procurorilor șefi în 2013 a fost un troc între președintele Traian Băsescu și premierul Victor Ponta, din care a câstigat mai mult fostul șef al statului, fapt devoalat și de fiica sa Elena Băsescu, care, mai limbută din fire, a scăpat ulterior porumbelul că tatăl său ar fi câștigat cu scorul de 5 la 1. Mai exact, Traian Băsescu a avut inițiativa și cuvântul decisiv în numirea procurorului șef al DNA , a procurorului șef al DIICOT și a adjunctului acestuia, precum și a celor doi adjuncți ai procurorului general al României, în timp ce Victor Ponta a avut inițiativa și cuvântul decisiv doar în ce privește numirea procurorului general al României, ale cărui atribuții au devenit tot mai limitate după ce infracțiuniile de corupție sau asimilate acestora au fost preluate de DNA, iar criminalitatea organizată a devenit apanajul DIICOT.” (Senator Valer Marian)
