STATUL DE DREPT ÎNTRE DEMOCRAŢIE ŞI AUTORITATE
Consider că una din condiţiile unui stat de drept este la nivel global realizarea stării de echilibru şi de convergenţă între puterea politică a statului şi puterea socială a cetăţeanului ca subiect condus.
La noi mentalitatea comună este că statul de drept reprezintă justiţia şi lupta anticorupţie. Într-o comunitate de hingheri sau în orice caz închisă, totul funcţionează după un cod, după nişte gesturi însuşite ritualic care să conducă la executarea misiunii asumate de liderii grupului. Tot aşa şi cu acest clişeu generalist care pune semnul egalităţii între statul de drept şi justiţie. În primul rând prin stat de drept, trebuie înţeles societate de drept, altfel statul de drept nu este altceva decât o concepţie sovietică, cosmetizată european.
Statul de drept înseamnă în primul rând promovarea drepturilor şi libertăţilor cetăţeneşti, asigurarea accesului la educaţie, resurse şi informaţii de interes public, înseamnă de asemenea combaterea sărăciei, a insecurităţii sociale, adică lucruri care implică justiţia. Justiţia socială este o componentă a justiţiei juridice, deci şi a statului de drept. Fiindcă toate problemele societăţii : nivelul de trai scăzut, şomajul, dependenţa economică, lipsa medicamentelor, exodul creierelor, excluziunea socială au drept cauză corupţia sistemică, a SISTEMULUI care a creat un mecanism legislativ de filtrare a legilor care permit fărădelegea, care legiferează ceea ce din punct de vedere moral este condamnabil.
Odată ce Ierarhia Statului este răsturnată, Autoritatea ca exerciţiu al Puterii devine un simulacru. Societatea de drept ca societate meritocratică, produce intelighenţia socială, organizând inteligenţele pe scara Ierarhiei sociale, iar intelighenţia socială dă naştere Elitei, care la rândul ei formează Ierarhia Statului, singura care asigură unitatea între vârful societăţii naţionale şi baza ei, garantând ordinea de drept. Totul natural.
Ei bine societatea românească a produs un model cultural de politică potrivit nivelului ei de trai, adică primitiv, cu un mare complex de inferioritate faţă de elementul străin şi un mare complex de superioritate la nivelul elitei intelectuale, fapt exprimat prin clişeele ,,noi suntem urmaşii Romei, tot ce-i românesc nu piere”, etc., adică teoria românului absolut.
Intelighenţia, Elita şi Ierarhia nu pot funcţiona în relaţie de subordonare faţă de dictatura economică a banului la nivel politic şi faţă de sindromul supravieţuirii la nivel social.
Suntem un popor dependent şi tocmai de aceea oscilăm între o democraţie globalistă de tip plutocratic, importată din exterior, şi manifestări de restaurare a autorităţii paternaliste a statului, folosind pervers toate mijloacele şi instituţiile democraţiei, inclusiv opinia publică pentru a obţine un rezultat punitiv asupra ,,duşmanilor de clasă”. De fapt cine sunt ,,duşmanii de clasă”? Toţi cei care promovează ,,politica” extraparlamentară adică îşi permit să critice, ceea ce poporul manipulat, îndoctrinat, pauperizat nu o face, fiindcă nu are drepturi şi conştiinţă politică superioare condiţiei sale de existenţă, lăsând ca arbitrariul politic să se manifeste subliminal, prin zgândărirea informaţiilor înseriate genetic în ADN-UL virusat de ideologia comunistă.
Avem o clasă socială formată din slugi cu mentalitate de stăpân şi o clasă politică formată din stăpâni cu mentalitate de slugi.
Revenind putem spune că egalitatea de şanse, libertatea socială, economică şi creatoare, siguranţa materială, armonia intereselor şi scopurilor membrilor societăţii reprezintă tot atâtea căi de realizare a statului de drept. Statul de drept trebuie să fie în viziunea noastră plenitudinea democraţiei politice cu finalitate socială. Ea capătă autoritate determinând organizarea activităţii şi vieţii comunităţilor umane pe fondul unei libertăţi dirijate raţional şi moral.
Democraţia reală într-un stat de drept se bazează pe valoarea morală şi meritocratică a libertăţii umane creatoare, pe modelarea şi reglementarea vieţii societăţii, pornind de la respectarea şi aplicarea normelor juridice, sociale şi etice, a legii şi Constituţiei statului. Din păcate, s-a dovedit că democraţia dirijată ca şi anarhia organizată sunt piedici în reformarea reală a societăţii. O astfel de democraţie aplicată de sus în jos nu este funcţională şi nu duce la progres real, la dezvoltare umană şi materială durabilă, la echilibru social şi la o viaţă sigură din toate punctele de vedere.
Experienţa istorică arată că între democraţie şi dezvoltare este o relaţie asimetrică. Nu democraţia este o condiţie a dezvoltării, ci dezvoltarea o condiţie a democraţiei. Cum spunea de altfel marele nostru poet Mihai Eminescu ,,libertate în sărăcie nu poate să fie”.
Democraţia nu exclude o guvernare forte, autoritară, bazată însă pe valori morale, pe instituţii puternice şi competente, pe sistemul de legi corelat cu drepturile sociale şi cu sistemul de educaţie. Totodată e nevoie de vectori informaţionali convergenţi care să menţină coeziunea socială pentru respectarea legilor drepte în vederea realizării comunităţii democratice de interese.
Dezvoltarea este o condiţie a statului de drept a oricărei democraţii cu adevărat meritocratice cu autoritate legitimă având la bază managementul participativ.
Un guvern puternic şi autoritar este cel care are la bază o democraţie solidă, putere socială şi un grad de conformitate al cetăţenilor faţă de lege şi instituţii. Din păcate multe legi au fost dictate de oligarhia financiară pentru a alimenta egoismele locale şi plutocraţiile globale, fiind dictate nu de democraţie, ca putere suverană a poporului, ci de xenocraţie. De asemenea, foarte important într-o democraţie reală este modul de conştientizare de către individul uman a obligaţiei de loialitate faţă de comunitate, faţă de societate. Fiindcă Statul de Drept este produsul Societăţii de Drept, nu invers. În acest sens abuzul de democraţie într-o societate deschisă poate fi uneori mai periculos de cât abuzul de autoritate într-o societate închisă, indiferent din ce parte vine. Se spune că românii au inventat democraţia, pentru ca să fure legal, prin guvern pe acei dintre ei care ,,creditează” acest sistem.
Într un stat de drept unde se probează eficienţa democraţiei participative reale, libertatea socială trebuie să fie o continuitate a libertăţii individuale, realizându-se astfel starea de concordie, de dreptate şi justiţie, expresie a egalităţii în diferenţă şi în interiorul Ierarhiei. La fel cum statul trebuie să fie responsabil de cerinţele societăţii, tot aşa şi societatea trebuie să fie conştientă de cerinţele şi interesele individului, după cum acesta este o forţă utilă comunităţii sale.
Autoritatea fără participare, fără implicarea individului în angajarea normelor comportamentului civic şi a misiunii bine definite a comunităţii nu poate fi realizată în condiţiile căderii în desuetitudine a valorilor sociale şi a compromiterii factorului decizional de putere. Dar conformitatea trebuie însoţită numai de participare, pentru a schimba un sistem de putere şi organizare social-politic corupt, imoral, degradat. Şi asta deoarece cetăţeanul nu se poate supune unor legi strâmbe, nedrepte. Gradul de autoritate este atins dacă se realizează în stat şi societate a stării de meritocraţie şi de personalism – comunitar. Avem nevoie de oameni politici credibili, competenţi, cu vocaţie morală şi socială. De aceea un rol revine societăţii civile şi a forţelor reformatoare, de dezvoltare ce pot consolida democraţia şi autoritatea. Dar numai o societate autonomă şi cu conştiinţa propriilor valori poate suporta sisteme democratice, fiindcă sistemele democratice din istoria lumii, care s-au dovedit eficiente au avut în spate o puternică cultură şi civilizaţie socială. Deci nu numai cultură, ca la noi, şi nu numai civilizaţie, ca în Occident.
Apreciez în mod critic că autonomia nu înseamnă anarhie. Dacă anarhia înseamnă negarea legii şi a progresului, autonomia socială înseamnă crearea legii proprii pe care şi-o dă o societate care-şi cunoaşte şi îşi dezvoltă resursele de putere. În acest context suntem pentru concilierea dintre aristocraţie în direcţia educării membrilor societăţii şi democraţie în direcţia perfecţionării justiţiei.
Consider că în Era Cunoaşterii guvernământul este un eşec la nivel ideologic şi administrativ dacă nu are drept prioritate educaţia, dar nu să o subordoneze, sau să o înstrăineze ca în Evul Mediu ci să-i aloce un procent de cel puţin 4% din PIB dar şi de ce nu din PID (produsul intern durabil).
Opinez că o clasă politică trebuie să fie peste condiţia unei societăţi de supravieţuire, nu prin stare materială proprie, ci prin reforma, educarea şi ridicarea standardului de viaţă a membrilor acelei societăţi. O elită nu se probează prin titluri sau bunuri ci prin impactul istoric şi social al proiectelor promovate. Astfel este o elită meritocratică. Educaţia şi Justiţia trebuie să stea la baza puterii, a statului şi nu invers. Binele social se împlineşte prin cultivarea valorii şi virtuţii mai mult decât prin formarea legilor şi a instituţiilor. Considerăm că legiferarea valorilor este absolut necesară pentru continuitatea democraţiei, a justiţiei sociale şi statului de drept fiind un mijloc de verificare a politicilor statului, a întreprinderilor individuale şi colective.
În concluzie democraţia nu exclude autoritatea. Nici democraţia nu trebuie să degenereze în anarhie sau haos organizaţional şi nici autoritatea în despotism sau arbitrariu. Pentru ca autoritatea, în general, să fie eficientă instituţiile nu trebuie ocolite, ci ,,trăite” şi practicate, ori tocmai pentru asta a fost creată regula meritului, fiindcă altfel, în absenţa pârghiilor civile instituţiile devin structuri birocratice amorfe, de tip clientelar sau instrumente ale reprimării şi muşamalizării.
