Pământul, o problemă de siguranță națională
Oficial, un milion de hectare de teren arabil din totalul de opt milioane sunt în proprietatea străinilor. Neoficial, prin interpuși, străinii controlează aproape patru milioane de hectare de pământ românesc cultivabil. Problema nu stă în modul în care îl exploatează, ci în faptul că producția și profitul pleacă din România.
Problema înstrăinării pământului agricol, deși discutată intens în ultimii ani, a ajuns abia acum și la urechile autorităților române. Prezent la ultima ediție a Târgului Agricol Indagra, președintele Klaus Iohannis a anunțat că este „îngrijorat“ că o treime din proprietarii de teren agricol din România sunt cetățeni străini.
„În momentul de față aflu de la domnul ministru (n.r. – Achim Irimescu) că proprietarii a 30% din terenul agricol din România sunt alții decât românii. Pe mine, personal, această proporție mă îngrijorează“, a declarat președintele României.
Procentajul de 30% vehiculat de Iohannis este însă eronat. Proporția pământurilor deținute de străini este mai mare. Aceasta este concluzia unui studiu realizat de Transnational Institute, la solicitarea Comisiei de Agricultură din cadrul Comisiei Europene, care încerca să stabilească cât din pământul statelor UE este deținut de cetățenii din afara Uniunii.
Oficial: un milion de hectare deținute de străini
Autorii studiului menționează că, de fapt, în jur de 20-30% din terenul arabil al ţării noastre aparţine cetăţenilor străini din UE, în timp ce alte 10% aparţin unor persoane rezidente în state non-UE.
Din estimările Transnational Institute, aproximativ 5,3 milioane de hectare, adică 40% din aproximativ 13,3 milioane de hectare, sunt exploatate de străini. Datele obținute de cei care au lucrat pentru Comisia Europeană provin, însă, în cazul României, din alte surse decât cele oficiale, deoarece autoritățile de la București nu s-au obosit nici măcar să strângă oficial astfel de informații.
De menționat că românii nu dețin nici măcar un hectar de teren arabil în vreo țară UE, potrivit datelor confederațiilor de agricultori.
40% din terenurile agricole ale României sunt în proprietatea străinilor, afirmă un studiu realizat pentru Comisia Agricolă Europeană. La acestea se adaugă și păduri, pășuni și teren intravilan, ceea ce face ca suprafața totală să depășească jumătate din teritoriul național.
„Din câte știm noi, în România sunt puțin peste opt milioane de hectare de teren arabil și, oficial, puțin peste un milion sunt deținute de străini. Neoficial, în fapt, prin interpuși, străinii dețin peste trei milioane de hectare, le controlează prin terți“, a declarat, pentru Cotidianul, Vasile Datcu, președintele Asociației Patronatului din Agricultură (APA).
În teritoriu, lucrurile nu sunt văzute deloc la fel ca la București. Nu există județ agricol din România în care străinii să nu aibă ferme. În Brăila, de exemplu, un grup de greci au cumpărat orezării pe la Stăncuța, livezi pe la Lacu Rezi-Însurăței și controlează zeci de mii de hectare de teren.
„Nu spune nimeni că e rău că investesc, că au cumpărat la noi. Problema este că ei cultivă ce vor, seacă terenurile, nu le tratează, iar producția și profitul le duc în bloc în străinătate“, a adăugat Vasile Datcu.Ministerul Agriculturii a lansat în discuție publică un proiect legislativ prin care prevede modificarea Legii vânzării terenurilor agricole. Ministrul Achim Irimescu a recunoscut că măsura a fost luată la presiunea fermierilor români, informează Agerpres.
Principalele modificări din lege sunt limitarea achiziției de teren agricol de către persoanele fizice la cel mult 50 de hectare, anumite condiții referitoare la cunoștințe de bază în domeniul agricol, desfășurarea unor activității agricole pentru o perioadă de minimum de 5 ani, precum și obligația de a menține destinația agricolă pe o perioadă de 10 ani, în care terenul nu poate fi revândut.
Legea să fie și să nu trebuiască
În prezent, în România, prețul unui hectar de teren agricol pleacă de la 2.000 de euro și poate ajunge până la 18.000 de euro, însă în țările UE poate depăși 30.000 de euro. România are 13,298 milioane de hectare teren agricol, din care peste 8 milioane hectare reprezintă suprafață arabilă.
Cotidianul a încercat să obțină de la Ministerul Agriculturii și Dezvoltării Rurale aceste date sau măcar ceva informații legate de problema pământurilor agricole. Purtătorul de cuvânt Raluca Panait ne-a oferit un răspuns tranșant: „Nu avem astfel de statistici. Au mai cerut și alți ziariști, dar… Nu există astfel de informații la noi, nu cred că o să găsiți. Nu există obligativitatea noastră de a întocmi asemenea evidențe“.Într-o dezbatere pe aceeași temă, ministrul Agriculturii Achim Irimescu, și-a exprimat aceeași îngrijorare cu privire la înstrăinarea pământurilor și a precizat că nici cadastrarea terenurilor nu s-a realizat, ba chiar sunt mari probleme la acest capitol, fiindcă sunt multe terenuri neidentificate, iar pentru soluționarea situației e nevoie de oameni: „Am rugat parlamentarii ca atunci când adoptă legea să modifice articolul prin care Ministerul Justiției ne-a impus ca atașații agricoli să fie doar funcționari“.
Nici astăzi nu s-a reușit completa cadastrare a terenurilor, darămite lămurirea proprietăților. Doar LAPAR și APA mai dețin câteva situații la zi. Cele două organizații confirmă faptul că, într-adevăr, pământul românesc încape bucată cu bucată pe mâna străinilor.
„Singurul mare avantaj sunt locurile de muncă. Măcar angajații sunt ai noștri. Dar vai și de salariile lor și de forma lor de angajare”, spun fermierii români.
România, în topul vânzătorilor de pământ
Bănuim totuși că datele nu sunt chiar secrete, odată ce Transnational Institute le-a putut găsi și în baza lor au putut stabili că România este unul dintre statele care au vândut cele mai mari suprafeţe străinilor.„Concentrarea fenomenului de acaparare a terenurilor agricole din Europa de Est este în mod particular alarmantă, având în vedere faptul că în tratatele de aderare la UE noile state membre din Europa de Est au obţinut perioade de tranziţie pentru liberalizarea pieţei de fond funciar. Informaţiile sugerează că România, Bulgaria, Ungaria şi Polonia sunt în mod particular puncte fierbinţi ale acestei probleme“, se arată în raport.
Liberalizarea pieței funciare din România a început la 1 ianuarie 2014, în conformitate cu prevederile negocierilor pentru aderarea la UE. Conform studiului mai sus menționat, cea mai mare fermă din România deținută de străini aparține companiei libaneze Maria Group, care dispune de o suprafață agricolă de circa 65.000 de hectare.

Grupul este unul dintre marii exportatori agricoli și exportă, în special, pe piețele din Orientul Mijlociu şi Africa de Est, carne şi cereale.Datele Comisiei Europene atestă că în România se găsesc şi cele mai numeroase ferme atipice deţinute de cetăţeni străini. Maria Group are sediul în localitatea Chirnogi din Călărași și este controlată de cetăţenii libanezo-englezi El Khalil Raji şi Jabre Nassif. Firma a fost implicată și în câteva dosare penale ale DIICOT, fiind suspectată de evaziune fiscală, contrabandă și spălare de bani.
Moșierii zilelor noastre au sânge străin
Un alt exemplu este firma Bardeau Holding, deținută de contele austriac Andreas von Bardeau, al cincilea cel mai mare proprietar de terenuri arabile din UE, care controlează 21.000 de hectare în Arad, Timiş, Caraş-Severin şi Argeş.
Și compania acestuia are propria infrastructură de transport, două centre de depozitare cu o capacitate totală de 32.000 de tone, capacităţi de procesare şi activităţi de marketing.
Banatul este una dintre zonele cele mai afectate de acest fenomen. Transnational Institute analizează cazul județului Timiș, unde în jur de 150.000 de hectare de teren arabil, o treime din total, sunt exploatate de companii italiene.
Dar nu doar marile companii sau grupuri agricole străine dețin teren agricol în România. Sub pretextul diversificării protofoliului investițional, grupurile bancare, fondurile de pensii şi marii asiguratori au devenit proprietari de pământuri agricole. Fenomenul este prezent în tot Estul Europei și de această dată România ocupă un loc fruntaș, secondată de Polonia.
Un studiu al Comisiei Europene menționază cazul olandezilor de la Rabobank, care, prin intermediul unui vehicul investiţional de 315 milioane de euro, Rabo Farm Europe Fund, operează în cele două state din Estul Europei. Un alt gigant financiar care deține importante suprafețe de pământ în România este și compania italo-austriacă de asigurări Generali, care deține 4.500 de hectare în vestul României, printr-o subsidiară locală. Acestea sunt printre primele 100 de companii agricole care operau în România și au legături cu Liban, Italia, Lituania, Danemarca, Olanda, Franța, SUA, Marea Britanie, Portugalia, Spania și Austria.
Încercări timide de reabilitare
În încercarea de a stopa fenomenul de acaparare a terenurilor agricole, Federația Națională Pro Agro a demarat, cu ocazia ultimei ediții a târgului Indagra, o acțiune a reprezentanților agricultorilor de revizuire a Constituției. Prin acest demers, inițiatorii speră să obțină declararea pământului ca patrimoniu național, pe model francez, și să oprescă astfel înstrăinarea acestuia.
Acțiunea respectivă prevede: „Nu ne mai putem permite să vindem străinilor aceste resurse esenţiale pentru ţară, în niciun fel de condiţii. Partenerii noştri din alte state europene pot investi în ţara noastră, pot face afaceri în general, în domeniul resurselor, însă doar în calitate de chiriași, concesionari ori arendași, și nu de proprietari“.
Studiul european vorbeşte şi despre efectele acestui fenomen asupra economiei locale. Conform analiștilor, mărirea numărului de astfel de exploataţii duce la creşterea numărului de şomeri din agricultură şi implicit al celor care pleacă din ţară pentru a-şi găsi un loc de muncă.
„Acest mod de a face agricultură se bazează pe monoculturi, folosirea intensivă a produselor chimice şi a medicamentelor (uz veterinar) în mod preventiv. Efectele apar atât asupra mediului şi animalelor, cât şi asupra ratei şomajului din mediul rural. Aceasta, întrucât în astfel de exploataţii se lucrează cu foarte puţini oameni. Spre exemplu, Genagricola, divizia pentru agricultură a Generali, care controlează 4.500 de hectare de teren în România, a generat doar 62 de joburi în 2013“, se mai arată în studiul mai sus citat.Suntem obișnuiți să auzim că investițiile străine creează locuri de muncă, dar conform celor de la Transnational Institute această afirmație este o utopie, în cazul investițiilor în terenuri agricole. Concluzia autorilor studiului este probată și de cei de la compania Emiliana West Rom. Firma deține o suprafață de 11.000 ha în vestul României, dar a creat doar 99 de locuri de muncă.
Experții de la UE au stabilit că acestă tendință se regăsește peste tot în Europa unde a fost dezvoltat acest model de exploatare agricolă. Astfel, între 2000 și 2012, 4,8 milioane de locuri de muncă cu normă întreagă au dispărut din agricultura țărilor membre UE.
„Pământul este un bun național. Nu poți trece cu vederea ce se întâmplă cu acesta, trebuie reglementare clară“, a declarat Laurențiu Baciu, președintele LAPAR România.
False locuri de muncă pentru români
„Noul val de investitori străini, intrat în România în ultimii doi ani, coroborat cu fuziunile dintre marile corporaţii, nu face altceva decât să crească viteza cu care românii de la sate pleacă peste graniţe pentru a-şi găsi un loc de muncă“, se mai precizează în raportul înaintat Comisiei de agricultură de la Bruxelles.Acapararea unor suprafețe cât mai întinse de teren de către marile holdinguri duce la dispariția fermierilor mici și mijlocii, la reducerea numărului de locuri de muncă, dar, mai ales, la diminuarea suveranității alimentare a țării.
Acesta este doar unul dintre motivele pentru care achiziționarea terenului agricol de la granițe de către străini poate fi privită ca o amenințare la adresa securității naționale. Cumpărarea de către străini a terenurilor din imediata apropiere a granițelor poate duce chiar și la ocuparea statului fără război.
Tocmai pentru a evita astfel de situații, alte state au impus reguli specifice. În cazul Poloniei, distanța de la granițe până la teren este de 150 de km. În cazul României, a fost nevoie de intervenția MApN ca legea vânzării terenurilor să majoreze distanța de la 10 la 20 de km de graniță.
România, insensibilă la legislație
În ianuarie 2015, Comitetul Economic și Social European (CESE) a atras atenția că „piața terenurilor agricole este reglementată foarte diferit în statele membre UE. În timp ce în unele țări există restricții, acestea lipsesc în alte state, ceea ce duce la apariția unor inegalități între statele membre“.
Drept urmare, CESE a propus ca în toate statele membre UE să fie stabilită, prin lege, o limită superioară pentru achiziționarea de terenuri agricole, atât pentru persoanele fizice, cât și pentru persoanele juridice.România este singura țară din Europa care nu a făcut vreo notificare către UE pentru instituirea de restricții la cumpărarea terenurilor de către străini.
În Tratatul de aderare la UE, încheiat de România, se preciza că terenul arabil este un „capital“, și nu un bun național, ca în cazul Franței sau al Ungariei. Partea din Tratatul de aderare referitoare la agricultură a fost negociată încă din 2004 de guvernul de atunci, condus de Adrian Năstase, care a acceptat orice condiții oferite de cei de la UE și pentru a beneficia de clemența liderilor europeni în privința corupției generalizate din țară.
FRANȚA: terenul agricol face parte din patrimoniul naţional și, conform legii, proprietarul nu poate face ce vrea cu pământul aflat în proprietate. Are una dintre cele mai elaborate legislații în domeniu, în scopul protejării propriilor agricultori și a pământurilor.
GERMANIA: nu poți cumpăra teren decât dacă faci parte din economia Germaniei, adică dacă faci dovada că plătești taxe în Germania. La aceasta se adaugă un elaborat instrumentar de protecție prin instrumente juridice, fiscale și de amenajare funciară publică.
