Codex Aureus pierdut de România în favoarea Ungariei la CEDO. Monica Macovei a pledat împotriva statului român
Unul dintre cele mai scumpe manuscrise din lume, care se afla la Biblioteca Batthyaneum din Alba Iulia, a fost pierdut de statul român. Ceaușescu ar fi garantat cu acest manuscris un împrumut de 10 milioane de dolari, o sumă uriașă în anii 70.
România a pierdut, după patrimoniul Fundaţiei Gojdu, poate cea mai valoroasă carte din lume, Codex Aureus. Manuscrisul a ajuns la unguri și totul s-a întâmplat cu concursul europarlamentarului român, Monica Macovei, care a pledat la CEDO împotriva statutului român și în favoarea Ungariei, ca să primească acest manuscris.
Care au fost etapele procedurale care au dus la pierderea manuscrisului
Maria Atanasiu a cerut la CEDO dreptul de proprietate asupra Codex Aureus deși nu are dreptul efectiv să îl primească pentru că România nu are o legislație în acest domeniu. Maria Atanasiu a cerut la CEDO restituirea mai multor proprietăți fiind o persoană care speculează legislația lacunară în domeniu din țara noastră. Ordonanța de urgență a Guvernului nr. 13/1998 ese un pic ilegală, dar și lacunară. Această ordonanță dată de Radu Vasile, fost premier al României, nu exprimă data la care trebuiesc restituite și bunurile mobile.
Astfel Maria Atanasiu care a cerut în numele său și al credincioșilor pe care îi reprezintă respectiv Arhiepiscopia Romano-Catolică de Alba Iulia pot avea doar speranțe legitime din partea statului român pentru dreptul de proprietate asupra Codex Aureus.
Monica Macovei, actualmente europarlamentar, a pledat la CEDO împotriva statului român pentru ca Maria Atanasiu și comunitatea etnică și religioasă să primească Codex Aureus. Arhiepiscopia Romano-Catolică de Alba Iulia a reuşit să înfrângă Opoziţia corectă şi legală a primarului şi Consiliului local din Alba Iulia și a primit Biblioteca Batthyaneum din Alba Iulia.
Valorea Codex Aureus este atât de mare încât, în 1968, Nicolae Ceauşescu a garantat un împrumut de 10 miliarde de dolari cu el. Codex Aureus,cel mai valoros manuscris din Biblioteca Batthyaneum şi din întreaga Europă. Este vorba de o carte scrisă în jurul anului 810 din porunca împăratului Carol cel Mare.
Codex Aureus, scris cu litere de aur
Această Evanghelie a fost scrisă cu litere de aur, pe foi fine de pergament, a fost pictată cu aur şi are coperţile din fildeş. Prima parte din Codex Aureus, cuprinzând în cele 111 file Evangheliile lui Matei şi Marcu, s-a aflat la Biblioteca Batthyaneum din Alba Iulia. Partea a doua din Codex Aureus, cuprinzând în cele 124 de file Evangheliile lui Luca şi Ioan, se află la Biblioteca Apostolică din Vatican.
Manuscrisul a fost realizat între anii 778 şi 820, în timpul lui Carol cel Mare. Volumul s-a aflat mai întâi la mănăstirea Lorsch din Germania, apoi, în secolul al XVI-lea, a fost dus la Heidelberg, de unde, în 1622, în urmă jefuirii bibliotecii de acolo de către soldaţii angajaţi în războiul de 30 de ani, a fost rupt în două, că să poată fi vândut mai uşor, detasandu-i-se coperţile.
Prima jumătate, cea mai bogat ilustrată, a ajuns în biblioteca contelui Migazzi, cardinal de Viena, care a vândut-o apoi lui Ignat Batthyani, episcopul de Alba Iulia. A doua parte a cărţii a ajuns în biblioteca Vaticanului, unde se păstrează sub un clopot de sticlă. În România cartea a intrat în proprietatea statului în anul 1918.
Manuscrisul este un evangheliar, de unde şi numele: Evangelium Scriptum cum auro pictum habens tabulas eburneas (Evanghelie scrisă cu cerneală de aur având table de fildeş).
Cum a ajuns patrimoniul Bibliotecii Batthyaneum în posesia poporului român
După Marea Unire de la Alba Iulia din 1 Decembrie 1918 şi în baza Tratatului de la Trianon, din iunie 1920, Biblioteca Batthyaneum cu tot fondul de carte, inclusiv Codex Aureus a intrat în proprietatea Poporului şi Statului Român. Biblioteca se află în zona istorică, pe str.Unirii nr.1-3 din municipiul Alba Iulia. Titular al dreptului de proprietate a fost Biblioteca Naţională a României.
În vara anului 1998, Guvernul Radu Vasile (format din miniştri din partea P.N.Ţ.C.D., U.D.M.R., P.N.L. şi P.D.) a aprobat O.U.G. nr.13 din 7 iulie privind restituirea unor bunuri imobile care au aparţinut comunităţilor cetăţenilor aparţinând minorităţilor naţionale din România.
Ordonanţa de urgenţă nr.13/1998, publicată în Monitorul Oficial nr.255 din 8 iulie 1998 a fost semnată de premierul Radu Vasile şi contrasemnată de Gyorgy Tokay, ministru delegat pe lângă primul-ministru pentru minorităţile naţionale. O.U.G.nr.13/1998 are trei articole (numerotate 1, 2 şi 2) şi a stabilit următoarele:
1. Clădirile şi terenurile aferente lor, cele înscrise în Anexă, trec gratuit în proprietatea comunităţilor cetăţenilor aparţinând minorităţilor naţionale.
2. Se înfiinţează o Comisie specială paritară (Guvern-minorităţi entice) care verifică situaţia juridică a celor 17 imobile înscrisă în Anexă şi poate face noi propuneri pentru donaţii către minorităţile etnice.
3. Predarea-preluarea imobilelor se face pe baza unor protocoale redactate de Comisia specială paritară.
La poziţia nr.13 din Anexa la O.U.G. nr.13/1998 este înscrisă Biblioteca Batthyaneum din Alba Iulia.
Este evident că O.U.G. nr.13/1998 nu se referă la restituirea fondului de carte şi a Codex Aureus către comunitatea maghiară din România şi către Ungaria.
După cinci ani, prin Legea nr.458 din 12 noiembrie 2003, a fost aprobată O.U.G. nr.13/1998. Lucrările Senatului au fost conduse de Doru Ioan Tărăcilă şi cele ale Camerei Deputaţilor de Viorel Hrebenciuc.
Separat de legislaţia existentă, prin aceste două acte normative, s-a furat Poporului Român Biblioteca Batthyaneum din Alba Iulia, inclusiv Codex Aureus, care au fost date ilegal comunităţii maghiare care nu are personalitate juridică şi care niciodată nu a fost proprietara acestei biblioteci, a Codex Aureus şi a uriaşului fond de carte, respectiv 115.992 unităţi bibliografice, din care: 1.778 manuscrise din secolul al IX-lea; 300 codice medievale (reprezentând 80% din cele existente în România); 571 incunabule şi 24.000 cărţi vechi din secolele XV-XVIII.
Biblioteca, situată pe strada Gabriel Bethlen din incinta Cetăţii, este destinată doar studiului ştiinţific şi nu este deschisă pentru vizitare turistică.
