Banditism de stat în Parlament. Ce scrie în legea pentru eliberarea corupţilor. Dedicaţie pentru Năstase
Parlamentarii pregătesc să voteze o scandaloasă lege de amnistiere şi de graţiere, în urma căreia poate fi distrusă toată lupta împotriva corupţiei din ultimii opt ani. O cohortă de demnitari judecaţi sau condamnaţi pentru corupţie scapă de puşcărie, iar unii dintre ei rămân şi cu cazierul curat. „Adevărul” vă arată cum ar urma să „lucreze” această lege în folosul infractorilor cu gulere albe.
Comisia juridică a Camerei Deputaţilor a luat în discuţie în secret, în noaptea de luni spre marţi, un controversat proiect de lege promovat insistent de deputaţii Nicolae Păun (Partida Romilor) şi Mădălin Voicu (PSD), privind amnistierea unor infracţiuni şi graţierea unor pedepse. Cei doi iniţiatori au avut o tentativă similară şi în legislatura trecută, însă aceasta a fost abandonată ca urmare a expirării mandatului precedentului Parlament. La vremea respectivă, proiectul a stârnit un veritabil scandal. Legea prevedea o serie de infracţiuni care erau exceptate de la amnistie şi graţiere, în general faptele comise cu violenţă, dar printre excepţii nu figura niciuna dintre faptele de corupţie din Codul Penal sau din legi speciale. “Poate a fost o scăpare, o vom corecta”, spunea atunci Nicolae Păun. Oamenii insistă În februarie anul acesta, după ce Parlamentul şi-a reluat lucrările în noua componenţă, Păun şi Voicu au recidivat şi au înaintat din nou acelaşi proiect de lege, însă nemodificat. Guvernul şi-a dat aviz negativ, iar Senatul l-a respins, rămânând ca decizia finală să aparţină Camerei Deputaţilor. Luni seara, în deplină clandestinitate, Comisia juridică a Camerei Deputaţilor a luat în discuţie proiectul de lege şi i-a adus câteva modificări, aparent cu scopul de a excepta şi fapte de corupţie de la amnistie şi graţiere. Însă la o lectură atentă a amendamentelor aduse se poate observa însă că acestea vizează fapte minore şi nesemnificative. Astfel, pe lista de excepţii în aplicarea amnistiei, s-au selectat şi inclus câteva infracţiuni de corupţie periferice, prevăzute atât de Codul Penal, cât şi de cele două legi speciale anticorupţie, 78/2000 şi 161/2003. La graţiere însă, pe lista excepţiilor, nu se mai regăseşte niciuna dintre faptele de corupţie, astfel încât dacă legea ar intra în vigoare în forma actuală, covârşitoarea majoritate a celor judecaţi sau condamnaţi pentru corupţie ar putea scăpa de închisoare. Pentru cine vine amnistia Amnistia este actul de autoritate publică prin care legiuitorul, pentru anumite infracţiuni, acordă clemenţă totală şi necondiţionată, ca şi cum fapta nu ar fi fost comisă. Făptuitorii rămân cu cazierul curat şi nu suportă nici o consecinţă pentru faptele lor. Iniţial, proiectul de lege prevedea amnistierea totală a faptelor pentru care legea prevede o pedeapsă maximă de până la 4 ani. Printr-un amendament, Comisia juridică a majorat acest prag la 7 ani, dar a inclus pe lista excepţiilor de la amnistie darea de mită şi primirea de foloase necuvenite, prevăzute de Codul Penal. Luarea de mită nu a fost inclusă pe lista excepţiilor, întrucât maximul de pedeapsă este de 15 ani, mai mare decât pragul de 7 ani. Pe lista excepţiilor au mai fost incluse patru infracţiuni de natură economică din Legea specială 78/2000, precum şi alte patru infracţiuni informatice prevăzute de Legea 161 din 2003. Pentru toate celelalte fapte de corupţie, dacă pedeapsa maximă este de până la 7 ani, se aplică amnistia. Dedicaţii pentru Năstase şi Voiculescu Cu precădere atrage atenţia omisiunea de a excepta de la amnistie infracţiunea prevăzută de articolul 13 din Legea 78/2000, care pedepseşte cu închisoare între 1 şi 5 ani liderii de partide, de ONG-uri sau de sindicate care îşi folosesc influenţa pentru a comite fapte de corupţie. Este articolul care stârneşte cele mai mari frisoane potentaţilor zilei, drept pentru care a şi rămas printre cele cărora li se aplica amnistia sau graţierea. În baza acestui articol, a fost condamnat definitiv la doi ani de închisoare Adrian Năstase, în “Trofeul Calităţii”, sau Dan Voiculescu, care a primit în primă instanţă 5 ani de închisoare în “Dosarul ICA”. Dacă legea iese aşa cum arată acum, cei doi vor avea cazierul alb. Pentru Adrian Năstase s-a mai făcut o dedicaţie pentru a i se albi complet cazierul. Cealaltă condamnare a sa, încă provizorie, este de 3 ani cu suspendare pentru şantaj exercitat de un demnitar. În Codul Penal, şantajul este pedepsit cu până la 5 ani, deci s-ar încadra la faptele amnistiate. Însă Năstase are agravanta că era demnitar când a comis şantajul, iar pedeapsa maximă prevăzută în Legea specială 78/2000 pentru această faptă este de până la 12 ani – deci nu ar trebui amnistiată. Numai că membrii Comisiei juridice au introdus un nou articol, care spune că infracţiunile vizate de lege se amnistiază şi în situaţia în care limita de pedeapsă, cea de 7 ani, a fost depăşită prin aplicarea dispoziţiilor unei legi speciale. Este exact situaţia lui Adrian Năstase, deci i se amnistiază şi şantajul. Graţierea, altă poveste. Free Gigi! Dacă amnistia se aplică unui număr relativ limitat de făptaşi, deputaţii au avut grijă ca măcar de graţiere să se bucure cât mai mulţi colegi de-ai lor. Graţierea este definită ca actul de clemenţă prin care infractorii sunt iertaţi de executarea efectivă a pedepsei, cazierul lor rămânând însă pătat. Proiectul de lege prevedea iniţial graţierea totală a pedepselor de până la şase ani, reducerea cu o treime a celor între 6 şi 8 ani şi cu o cincime a celor între 8 şi 10 ani. Comisia juridică a adăugat că se graţiază cu jumătate şi pedepsele infractorilor care au peste 60 de ani, femeile gravide sau persoanele bolnave incurabil. Pe lista infracţiunilor exceptate de la graţiere nu se găseşte absolut niciuna dintre cele privitoare la fapte de corupţie. Mai mult, Comisia juridică a scos de pe lista iniţială a excepţiilor, deci vor fi graţiate, şi infracţiuni precum înşelăciunea, delapidarea, traficul de stupefiante, ultrajul, falsificarea de monedă sau de valori. O altă infracţiune eliminată din lista excepţiilor de către Comisia juridică este “Lipsirea de libertate în mod ilegal”, adică exact una dintre cele pentru care Gigi Becali execută trei ani şi jumătate de închisoare. Cealaltă faptă pentru care a fost condamnat, datrea de mită, intră oricum în sfera celor graţiate, deci dacă proiectul este adoptat în forma actuală, Gigi Becali redevine un om liber. Ultimul articol al legii spune că prevederile acesteia se aplică infracţiunilor săvârşite – şi nu sentinţelor definitive pronunţate – până la intrarea sa în vigoare, ceea ce înseamnă că amnistia şi graţierea se aplică atât dosarelor aflate încă în ancheta Parchetelor, câtşi proceselor aflate pe rolul instanţelor. Ieri, în faţa iminentului scandal declanşat de punerea pe rol a acestei legi, preşedintele Camerei Deputaţilor, Valeriu Zgonea, a decis amânarea votării în plen a controversatului proiect de lege. Pretextul legii Iniţiatorii susţin necesitatea legii de amnistie şi graţiere prin aceea că penitenciarele sunt supraaglomerate. Însă ca să eliberezi penitenciarele era suficientă doar o graţiere, nu şi amnistia. Iar şeful Comisiei juridice, deputatul Bogdan Ciucă (PC), a invocat că CEDO ar pregăti o hotărâre-pilot împotriva României, tot pe tema situaţiei din Penitenciare, aşa cum a mai emis una în problematica retrocedărilor proprietăţilor confiscate de comunişti. Informaţia furnizată de Bogdan Ciucă este pur şi simplu falsă: CEDO nu are în vedere aşa ceva, după cum ne-a declarat unul dintre reprezentanţii statului român pe lângă Curtea Europeană a Drepturilor Omului. CEDO a emis o hotărâre, Iacob Stanciu contra României, în care sesizează probleme de sistem în penitenciarele româneşti, dar e departe de a formula o hotărâre-pilot. Iar sancţiunile dispuse de CEDO pentru cei care se plâng de condiţiile de detenţie se ridică la câteva mii de euro pentru fiecare caz. Lista politicienilor albiţi prin lege Dacă legea va intra în vigoare în forma actuală, vor scăpa de închisoare prin graţiere sau vor avea chiar cazierul albit prin amnistie o pleiadă întreagă de demnitari.
1. Adrian Năstase (fost premier) – 3 ani de închisoare pentru şantaj (nedefinitivă). Chiar dacă la recurs primeşte o pedeapsă mai mare de 7 ani, infracţiunea tot ar fi amnistiată. Condamnarea la doi ani de închisoare în „Trofeul Calităţii”, executată, ar fi amnistiată. 2. Dan Voiculescu (fost senator) – 5 ani de închisoare în „Dosarul ICA“. Voiculescu ar scăpa de închisoare, infracţiunea fiind amnistiată. În dosarul de şantaj al Antena 3, pedeapsa sa şi a celorlalţi inculpaţi ar fi amnistiată. 3. Cătălin Voicu (fost senator) – 5 ani de închisoare pentru corupţie, în prezent încarcerat la Jilava. Va ieşi din închisoare prin graţierea pedepsei pe care o execută. 4. Relu Fenechiu (fost ministru) – 5 ani de închisoare în dosarul „Transformatorul“ (nedefinitivă). Va scăpa de închisoare prin graţierea pedepsei. 5. Decebal Traian Remeş (fost ministru) – 3 ani de închisoare în dosarul “Caltaboşul”, în prezent încarcerat. Va ieşi din închisoare prin graţiere. 6. Codruţ Şereş (fost ministru) – 6 ani de închisoare pentru trădare. Dacă în recurs pedeapsa nu va fi mărită, aceasta va fi graţiată. 7. Miron Mitrea (fost ministru) – Judecat în primă instanţă pentru luare de mită. Dacă va fi găsit vinovat şi condamnat la o pedeapsă de până în 6 ani de închisoare, aceasta va fi graţiată. 8. Liviu Dragnea (vicepremier) – Judecat în primă instanţă în dosarul „Fraudă la Referendum“. Infracţiunile de care este acuzat ar fi amnistiate. 9. Adrian Severin (europarlamentar) – Judecat pentru luare de mită pentru lobby în Parlamentul European. Dacă va fi condamnat la o pedeapsă de până la 6 ani, aceasta va fi graţiată. 10. Radu Mazăre (primar) – Trimis în judecată pentru retrocedări ilegale de terenuri. Ar scăpa de închisoare prin amnistierea unor infracţiuni şi graţierea celorlalte. 11. George Becali (fost deputat) – Condamnat în „Dosarul Valiza“ şi în „Dosarul hoţilor“. Ambele infracţiuni vor fi graţiate. 12. Ioan Avram Mureşan (fost ministru) – Condamnat la şapte ani de închisoare pentru deturnare de fonduri şi abuz în serviciu, infracţiunile ar fi amnistiate. Condamnat la 3 ani de închisoare pentru luare de mită în dosarul „Caltaboşul“, pedeapsa ar fi graţiată. (Andrei Aştefănesei)
