“România ultimului deceniu și jumătate s-a confruntat cu o mega-escrocherie recunoscută azi unanim drept afacerea secolului. E vorba de scandalul retrocedărilor, grație căreia o mînă de indivizi cu relații sus-puse au înșfăcat imobile, terenuri, bunuri de patrimoniu șamd, în numele adevăraților moștenitori”, scrie Bogdan Tiberiu Iacob pe inpolitics.ro.
“Majoritatea zdrobitoare a acestora nu vor păți nimic, iar bunurile furate odată de comuniști și securiști și a doua oară de urmașii acestora, le vor rămîne veșnic în posesie, de această dată în mod ”democratic”. Iar faptele lor vor rămîne veșnic nepedepsite, după cum a explicat la un moment dat DNA, într-un comunicat care ar fi meritat mai multă atenție.

În prezent, sunt anchetate în asemenea scandaluri cîteva figuri grele, de la Viorel Hrebenciuc la prințul Paul, dar asta e doar o picătură din totalul șmenurilor de acest tip care s-au făcut în ultimii 15 ani.Majoritatea zdrobitoare a beneficiarilor afacerii secolului vor rămîne, cum spuneam, neatinși și cu ce au furat în posesie.

Simplu: de la DNA.
Evident, ”zmeii” anticorupției au făcut de așa manieră încît să-și ”curețe” conștiința fix în ultimul moment, cînd nu se mai putea face nimic.
Așa se face că pe 30 ianuarie 2014, cu O ZI (s.n.) înaintea intrării în vigoare a noilor coduri penale pritocite ani de zile de Predoiu & comp., DNA a dat publicității următorul comunicat:
”Direcţia Naţională Anticorupţie îşi exprimă deosebita îngrijorare privind intrarea în vigoare, în forma adoptată de Parlament, a prevederilor Noului Cod Penal şi ale Noului Cod de Procedură Penală la data de 1 februarie 2014, situaţie în care există un risc major ca eficienţa investigaţiilor în cauzele de corupţie să fie semnificativ diminuată.
Astfel, următoarele situaţii reprezintă exemple în sensul celor sus menţionate:
1. Intrarea în vigoare a noului Cod penal în forma actuală ar înlătura răspunderea penală a unor persoane acuzate de săvârşirea infracţiunii de înşelăciune care a produs consecinţe deosebit de grave.Faptele menţionate sunt sancţionate în prezent cu închisoare de la 10 la 20 de ani, iar în noua reglementare vor fi pedepsite cu închisoare de la unu la 5 ani, astfel încât termenul de prescripţie a răspunderii penale se va reduce de la 15 la 5 ani.
Având în vedere că multe înşelăciuni comise în dauna statului, precum cele săvârşite cu ocazia reconstituirii dreptului de proprietate, sunt identificate după mulţi ani de la săvârşire, prevederea din Noul Cod penal va împiedica tragerea la răspundere a autorilor unor asemenea fapte.
Aplicarea normelor de drept penal se face în considerarea principiului legii mai favorabile, astfel încât intrarea în vigoare a textului în această formă chiar pentru o singură zi va determina încetarea procesului penal în cauze având acest obiect.
Din estimările DNA, 12 cauze aflate pe rolul instanţelor sunt în situaţia de a fi închise în cursul anului 2014, iar 23 în cursul anului 2015, ca urmare a micşorării limitelor de pedeapsă reglementate de noul cod. Totodată, în 64 de cauze aflate în curs de urmărire penală la DNA urmează să se împlinească termenul de prescripţie a răspunderii penale din acelaşi motiv.
Totodată, persoanele condamnate definitiv pentru infracţiuni de înşelăciune cu consecinţe deosebit de grave vor beneficia de aplicarea legii mai favorabile şi de reducerea obligatorie a pedepsei la 5 ani de închisoare”.
