Ne retrocedăm țara criminalilor de război!
Dr. Ilie Gherheș: „Statul Român se află în fața unei mari escrocherii istorice”
Romania Mica fara Ardeal, retrocedat fraudulos
Nu ne vindem țara, o retrocedăm, pe bucăți, fără să ținem seama de tratate, legi, sentințe sau victimele din cele două conflagrații mondiale. Din măsuri reparatorii și juste, retrocedările au devenit un flagel injust, periculos și imoral, profund scăpat de sub control. Familiile criminalilor de război au ajuns să dobândească imobile și bunuri de o valoare inestimabilă, fără ca cineva să țină seama de contextul și modul în care averea lor a ajuns în proprietatea Statului Român.
Ungaria anexează Ardealul pe bucăți! Trei premieri, Adrian Năstase, Călin Popescu Tăriceanu și Victor Ponta au deschis poarta trădării, astfel că, din unele statistici, mai bine de o treime din teritoriul Transilvaniei a fost intabulat pe emisari ai Ungariei: urmași de grofi, nobili, asociații, reprezentanți ai cultelor.
Problema e că legile retrocedărilor nu fac distincția între clădirile confiscate de comuniști și cele confiscate prin sentințe penale date pentru criminali de război. Cum o parte dintre documente se află încă în arhivele de la Budapesta, în multe cazuri nu se poate face măcar dovada confiscării averii nobililor declarați criminali de război.
Mai mult, în instanțe se iau în considerare intabulări din cărțile funciare din perioada ocupației maghiare, deși potrivit Legii nr. 260 din 4 aprilie 1945, toate înscrisurile în cărțile funciare efectuate în perioada 1940-1944 au fost declarate nule de drept! Dar în multe cărți funciare, aceste modificări nu au fost operate.
Mai mult, nu se iau în calcul despăgubirile acordate de Statul român pentru imobilele pe care le-a avut în proprietate Statul ungar în Ardeal, până la 1 Decembrie 1918, precum și pentru optanții unguri (Sub această denumire de optanți sunt cunoscuți acei cetățeni români de etnie ungară care, după Tratatul de la Trianon, au optat pentru cetățenia Ungariei și au părăsit România).
Mai mult, după 23 august 1944 și în baza art.8 din Convenția de armistițiu semnată la Moscova, în 12 septembrie 1944, bunurile reprezentând proprietatea Ungariei și Germaniei de pe teritoriul României au fost sechestrate și, în baza Legii nr. 91 din 9 februarie 1945, au fost puse sub supravegherea Casei de Administrare și Supraveghere a Bunurilor Inamice (C.A.S.B.I.).
Aceste bunuri nu au fost confiscate de regimul comunist și, ca urmare, nu pot face obiectul retrocedărilor către Ungaria și Germania. Și totuși fac. Practic, legile retrocedărilor date în ultimii ani și instanțele de judecată șterg cu buretele o istorie de trei decenii și jertfele românilor din cele două războaie mondiale.
Zeci de hectare de teren, păduri, imobile ajung în proprietatea succesorilor criminalilor de război sau a unor interpuși.
Vreți exemple? Vă dăm.
Începem cu unul dintre cele mai importante cazuri de retrocedare din Ardeal. Domeniul Teleki. Proprietăți care au aparținut contelui Adam Teleki, membru în guvernul Ungariei în perioada hortystă. În 1945, Teleki a fost considerat trădător de țară, dar actele prin care i s-au expropiat bunurile, cum se întâmplă în astfel de cazuri, nu au fost găsite. Așa că moștenitorii contelui și-au revendicat bunurile, întinse pe mai multe județe: Maramureș, Mureș, Sălaj. În total, familia a deschis vreo 20 de procese, dintre care unul pentru 100 de hectare de pădure în Ardusat. Castelele din Coltău și Satulung nu au fost revendicate.
Codrii Ardealului sunt ceruți de urmașii familiei Banffy. Daniel Banffy, fost ministru al agriculturii în Guvernul hortyst, a fost și el declarat criminal de război. Urmașii lui cer însă în instanță sute de hectare de pădure. Familia Banffy a deținut domenii întinse și în Țara Lăpușului, care face obiectul a patru dosare de restituire a câte 60 hectare de pădure fiecare. Numai că se spune că baronul și-ar fi vândut averea prin 1940.
Alt caz răsunător este al familiei Szaplonczai. Szaplonczai Vasile, membru al partidului iredentist, fost prefect al județului Maramureș, a fost condamnat printr-o sentință a Tribunalului Poporului pentru „complicitate la crimele prevăzute de art. 2. lit. h. și m. și pentru … prevăzute de art. 2. lit. o. din Legea nr. 312/1945”, adică „au comis acte de violență, torturi sau alte mijloace ilegale de constrângere” și „Au ordonat sau inițiat înființări de ghetouri, lagăre de internare ori deportări din motive de persecuție politică sau rasială” la 25 de ani de muncă silnică.
Mai exact, prin Hotărârea nr. 8, pronunțată în Ședința publică din 31 mai 1946, se arată implicarea lui Szaplonczai Vasile în problema evreiască: „În orașul Sighet, ghetoul s-a înființat în 2 cartiere periferice ale orașului, permițându-se celor internați să locuiască în casele din aceste cartiere, dar cum numărul celor internați întrecea capacitatea de cazare a perimetrului ghetoului, oamenii au fost nevoiți să stea și prin pivnițe, poduri de casă și șoproane. Perimetrul ghetoului a fost împrejmuit cu sârmă ghimpată, iar ferestrele au fost vopsite cu var, pentru ca locatarii caselor să nu poată privi în afară. După cum s-a dovedit în cursul instrucției în fața completului de judecată, ghetoul din Sighet a fost înființat ceva mai înainte decât celelalte ghetouri în Ardealul de Nord. (…)
Primăria, prin acuzații dr. Gyulafalvi Rednik Alexandru, primar, și prin substituitul său, acuzatul Hullman Francisc, prim-notar al primăriei nu s-a îngrijit de aprovizionarea celor internați în ghetou, lăsându-i fără alimente. Aceste autorități comunale (municipale – nn) au refuzat până și punerea la dispoziție pe seama celor internați a vacilor cu lapte proprietate a evreilor, lapte necesar pentru copii sugaci.
Din cauza acestor dispozițiuni de cazare și alimentare s-au ivit multe cazuri de tifos exantematic, după cum rezultă din raportul nr. 8982 din 8 mai 1944 al primarului orașului către Ministerul de Interne. Dar punctul culminant și aici, ca și în celelalte ghetouri, l-a format cercetarea după valorile ascunse, cercetare întreprinsă de echipele colonelului Agy Zoltán și ale acuzatului Toth Ludovic.
Încă de la intrarea în ghetou, jandarmii, polițiștii și funcționarii primăriei au făcut percheziție corporală atât bărbaților, cât și femeilor, nelăsând la o parte nici percheziția vaginală, chiar la fetițe de 8 ani și cu această ocazie au confiscat obiectele apreciate de ei, ca fiind de valoare.
Martora Rosenberg Margareta a arătat în depoziția sa, cum femeilor așezate la perete – dezbrăcându-le la piele și sub amenințarea împușcării – le făceau percheziție în vagin și la anus. (…)
Prefectul județului Maramureș în acest timp apocaliptic pentru națiunea evreiască conlocuitoare a fost acuzatul SZAPLONCZAI VASILE, membru al partidului iredentist.
Responsabilitatea sa este responsabilitatea tuturor prefecților din acel timp”.
Evident, la data pronunțării sentinței, Vasile Szaplonczai era dispărut. Urmașii familiei sale au reapărut însă, și revendică moșia familiei din satul Tisa. Ultimii proprietari ai moșiei din Tisa, comuna Crăciunești au fost Zoltan și Paul Szaplonczaz, primul probabil fiul lui Laszlo-Vasile Szaplonczay, iar Paul, nepotul său.
Reședința lui Zoltan este revendicată de o nepoată a sa, procesul fiind încă pe rol. Bătrânii satului spun că Zoltan și-ar fi vândut moșia în 1938 și cu banii rezultați și-ar fi cumpărat alta în Ungaria, dar odată cu ocupația maghiară a venit înapoi, revendicându-și moșia și spunând că oamenii l-ar fi forțat să le vândă terenul. Plus că se pare că a fost și criminal de război.
Oricum, amândoi au fugit în 1944 din țară. Și totuși, acum urmașii lor redobândesc bunurile.
Secretarul primăriei Bocicoiu Mare, Vasile Hașciar, spune că: „Pentru Paul Szaplonczai am revendicat bunurile pe Legea 1. Acum pe 247 ne-a revendicat școala și nu numai, terenul aferent și pădurea. Aceste bunuri sunt cerute după Szaploncyaz Zoltan. Comisia locală a dat soluția de respingere pentru că trebuia să facă dovada cetățeniei și a proprietății. Nu a făcut dovada cetățeniei. Au contestat decizia comisiei locale la comisia județeană, care la fel a propus respingere în întreg a cererii tot pe acest fond. Atunci ei s-au îndreptat în instanță și de 3 ani suntem în proces. S-au cerut dovezi pentru cetățenie, pentru planul de amplasament, s-a făcut expertiză. Acel conac e școală, școala a fost construită, s-a făcut și școala nouă și nu puteam fi de acord cu retrocedarea. În instanța de fond, judecătorul a respins plângerea, dar a făcut recurs. Ceva nepoată de-a lui revendică terenul. Se pare că Laszlo Szaplonczai a fost tatăl lui Zoltan. Ei au avut jumătate din Maramureșul Istoric. Au revendicat și prin Sighet. Lui Paul i s-au restituit 50 de hectare în zona lacului. Zoltan este verișorul lui Paul”.
Deh, cine mai stă să verifice mizilicuri gen: dacă aceștia au fost declarați criminali de război și condamnați, dacă cărțile funciare în baza cărora se revendică bunurile sunt din perioada ocupației ungare, dacă și cât au primit despăgubiri? Nobili hortyști pun din nou stăpânire pe Ardeal, la fel de abuziv și ilegal, dar, de această dată, cu girul instanțelor de judecată, a legii și Guvernului, în disprețul adevărului istoric și militarilor români morți pentru eliberarea acestui pământ românesc.

În acest moment, Statul Român se află în fața unei mari escrocherii istorice. Escrocheria nu ar putea avea probabil loc dacă nu ar fi și o complicitate din interior. După Primul Război Mondial au fost așa numitele procese ale „octanților” și după cel de-al Doilea Război Mondial ale „absenteiștilor”.
Ce se întâmplă acum? Vin urmașii acelor proprietari, care, unii dintre ei, culmea, au fost despăgubiți după Primul Război Mondial. Iar acum vin cu documente anterioare proceselor prin care părinții lor sau bunicii lor au fost deposedați de averi sau au fost răsplătiți de stat la modul general. Și mai cer încă o dată sau încă de două ori sau încă de trei ori.
Niciun evreu sau niciun maghiar dintre aceia mari nu va mai veni să locuiască în Transilvania sau într-o localitate din Maramureșul Istoric sau oricare județ. Nu este vorba numai de județul nostru, e vorba de tot Ardealul. Dar toată lumea se îndreaptă spre o despăgubire cât mai mare din partea Statului Român. Și atunci, își angajează avocați buni și se judecă cu Statul Român.
Din start pot să piardă toate procesele cu România, iar în altă parte le câștigă „fluierând”. Pot să spun cu toată răspunderea, că am fost director la Arhivele Statului și, ca om care umblă în aceste arhive, că pe Transilvania sunt firme care vin și cercetează după niște metode foarte minuțios elaborate exact pe aceste posibilități ale viitoarelor procese pe care să le câștige mai ales dincolo de granițele țării.
Deci suntem pur și simplu escrocați!
Au murit de pomană cei care au luptat pentru eliberarea Ardealului și cei care au luptat împotriva fascismului sau a hortyștilor etc.
Este o bătaie de joc postumă la adresa armatei române. Am avut sute de mii de victime, iar acum se calcă pe mormintele acelor oameni exact pe ideea de a câștiga. Și din păcate, Statul Român este descoperit sau foarte slab apărat. Este atât de simplu inclusiv să se falsifice un document, dar nu asta-i problema că sunt hotărâri judecătorești din perioada interbelică. Dar o parte dintre cei care au fost colaboratorii hortismului s-au retras împreună cu armatele și atunci li s-a confiscat totul, iar ei au devenit absenteiști.
Ei au plecat, să zicem, în ’44, dar cei care vin acum vin cu documente din ’38, ’41 sau ’44. Deci sunt documente anterioare hotărârilor judecătorești. Și înconjoară acest moment”.
